The Companies consider the security of your personal data to be a priority.
In the sense of the General Data Protection Regulation (Regulation (EU) 2016/679), the Companies act as a joint controller of your personal data, meaning that the Companies collect, retain and use (and otherwise process) your personal data for the performance of their business activities (the individual purposes for which the personal data are processed are delineated below), which, in particular, consist in the purchase, sale, management and maintenance of real estate.
This Privacy Policy applies to (i) the processing of personal data carried out by the Companies when you use the website www.bdluziny.cz (hereinafter referred to as the “Website”), (ii) the processing of personal data carried out by the Companies when communicating with you by e-mail or telephone, (iii) the processing of personal data by the Companies during a business relationship with clients and suppliers, (iv) processing of personal data in the performance of the Companies’ legal obligations, and (v) the processing of personal data as necessary for the purposes of protecting the Companies’ legitimate interests.
This Privacy Policy describes the purposes of personal data processing as well as the methods of processing and provides information about the individual categories of the personal data processed, their recipients, if any, the period of storage of personal data and your rights in relation to personal data protection.

PURPOSES OF PERSONAL DATA PROCESSING

Your personal data may be processed by the Companies for the following purposes:

  • Handling of requests sent via electronic forms (in particular, responses to your queries or requests, communication with you as senders of messages via a contact form, registration of queries received for possible future contact)
  • Performance of contracts, including negotiation of contracts 
  • Performance of legal obligations (primarily the obligations in the sense of accounting and tax legislation, i.e. the transfer of personal data to financial authorities in accordance with applicable legal regulations)
  • Sending of commercial communications, offers of services and products (the Companies may send commercial communications or newsletters, especially offers of real estate, and offer related services by e-mail);
  • Protection of the controller’s legitimate interest (protection of rights and the Companies’ interests protected by law, e.g. identification of persons under Act 253/2008 Coll., on Selected Measures against Legitimisation of Proceeds of Crime and Financing of Terrorism, protection of the network against damaging conduct or protection against misuse of the Website);

Personal data are processed by the Companies both manually and by automated means. Automated processing of personal data takes place chiefly for the purposes of performance of contractual relations and offers of services.
The Companies are entitled to collect, store and use certain information by automated means, e.g. statistical information whenever you visit the Web Portal.

CONSENT-BASED PROCESSING OF PERSONAL DATA

If you give the Companies your consent to the processing of your personal data for the purposes of sending personalised marketing communications (in which case, profiling may also be carried out) or for the purposes of addressing you with offers of the Companies’ services and products, by e-mail or telephone, you acknowledge that the provision of such consent is voluntary, and you may revoke your consent at any time, specifically in writing to the Companies’ address or using the link provided in the e-mail message containing the commercial communication. The consent is valid until it is revoked. Failure to provide consent will not affect the performance of contract.

RECIPIENTS OF PERSONAL DATA

Your personal data are made accessible by the Companies only to authorised employees and collaborators or the individual processors of personal data contracted by the Companies, or, as the case may be, to other controllers; however, this shall be done at all times only to an extent necessary to fulfil the individual purposes of processing and on the basis of the corresponding legal title for personal data processing.
Since the Companies are members of a group of companies, please note that if the Companies have an appropriate legal title, they may be entitled to share personal data across the group of companies, both for administrative and business support purposes. You may object to the sharing of personal data across the group of companies at any time by writing to the contact e-mail.
In the instances set out in law, the Companies are entitled, or obliged, as appropriate, to transfer certain personal data based on applicable legal regulations, e.g. to law enforcement authorities or other public authorities.

PERSONAL DATA OF THIRD PARTIES

Personal data of third parties, which are understood as personal data of employees and customers of clients or suppliers of the Companies and other persons involved in the cooperation with the Companies, or any other data received by the Companies from clients or suppliers in connection with the entry into or performance of contracts, will be processed in accordance with applicable legal regulations concerning personal data protection. The above personal data will be used by the Companies for the purposes of performance of contracts with clients or suppliers. The Companies will process personal data of third parties during the term of contractual relationships and for the period determined in separate legal regulations, if any. The above personal data will be stored for a longer period if a justified need to store the data arises in connection with a specific case.

RETENTION PERIOD OF PERSONAL DATA

Your personal data are processed and stored by the Companies for a period necessary to discharge all rights and obligations arising from the respective contractual relationship and further for a period during which the Companies, as data controllers, are obliged to retain personal data in accordance with legislation of general application, or for a period for which you have given the Companies your consent to the processing of personal data. In other cases, the retention period of processing is based on the purposes of processing with which it must be commensurate, or which is laid down in legal regulations concerning personal data protection.

RIGHTS OF DATA SUBJECTS

As a data subject, you have rights in relation to the processing of personal data that are derived from legal regulations, and which may be exercised by you at any time. These rights include the right (i) of access to personal data, (ii) to have inaccurate data rectified and incomplete data completed, (iii) to have personal data erased provided that the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed, or if it has been determined that the personal data have been unlawfully processed, (iv) to restriction of personal data processing, (v) to data portability, (vi) to object, after which the processing of personal data will be terminated, unless the Companies demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subjects, especially in the case of the establishment, exercise or defence of legal claims, and (vii) to refer to the Office for Personal Data Protection.

  • Right of access to personal data: If you wish to know whether the Companies process your personal data, you have a right to obtain information whether or not your personal data are processed, and where that is the case, you also have a right to obtain access to your personal data.
  • Right to rectification of inaccurate and completion of incomplete personal data: If you believe that the Companies process inaccurate or incomplete personal data about you, you have the right to request the rectification or completion of such data. The Companies will rectify or complete the data without undue delay, but at all times taking account of technical capabilities.
  • Right to erasure: If you request erasure, the Companies will erase your personal data under the condition that (i) your data are no longer necessary for the purposes for which they have been collected or otherwise processed, (ii) the processing is unlawful, (iii) you have objected to the processing and there are no overriding legitimate grounds for the processing of your personal data, or (iv) a statutory obligation to process the personal data under the European Union law or national legal regulations no longer exists.
  • Right to restriction of personal data processing: If you request the restriction of processing, the Companies will make the personal data inaccessible, temporary delete or store the data, or the Companies will carry out any other processing operations as necessary for the right asserted to be exercised.
  • Right to data portability: If you want the personal data processed by the Companies in electronic form based on a contract or consent which you have provided to the Companies to be transferred by the Companies to a third party, you may exercise your right to data portability. If the exercise of the above right affects the rights and freedoms of other persons adversely, your request will not be granted by the Companies.
  • Right to object: The right to object to the processing of the personal data processed for the purposes of the performance of a task carried out in the public interest or in the exercise of official authority or for the purposes of protection of the Companies’ legitimate interests. If the

Companies fail to demonstrate the existence of serious legitimate grounds for processing, overriding the client’s interests, rights and freedoms, the processing will be terminated upon the objection without any undue delay.
In the case of repeated or apparently unfounded requests for the exercise of the aforementioned rights, the Companies are entitled to charge a reasonable fee for the exercise of the given right or to refuse to grant the request. Clients will be informed if that is the case.
